Every year, the degree of government oversight of the remodeling and home improvement industry increases at both the state and federal level. Laws increase in complexity, more and more areas become regulated, and consumers become more sophisticated – all the while the contractor is working off of information and procedures that are increasingly outdated, ineffective, and prone to create liability when discovered and challenged by aggressive lawyers or government agencies.

Using our knowledge of the industry, we partner with our clients to help them navigate the industry pitfalls. We advise manufacturers and contractors on all applicable operational and compliance issues, including pricing and sale policies, sales tax, customer rights of cancellation, lead paint, fuel savings pledges, telemarketing, advertisements, sweepstakes, etc. We also provide policies, procedures, and necessary postings required under federal and state consumer protection laws (do-not-call, worker classification, etc.).

We handle licensing and registration issues in all 50 states and the District of Columbia. By understanding the issues and by maintaining ongoing relationships with state agency licensing personnel, we ensure that our clients obtain and maintain the necessary licensure and registrations.

For clients offering financing to their customers, we provide counseling on the complex interplay of retail installment and lending laws in all 50 states and the District of Columbia. Many clients are not aware that financing arising from home improvement transactions often require separate licensing for both the lender and the contractor in many states, and in some states require licensing as a mortgage lender or broker as well.
